Case Example: Accidents Involving Alcohol or Drugs

 

A husband and wife were taking a walk after dinner along the two-lane road near their home. As they were walking along the right side of the road, a vehicle approaching from the rear left the travel lane and struck and killed the wife who was walking several feet off the road. The driver of the vehicle was found to be intoxicated/impaired on alcohol and prescription medication. Through the investigation after the accident, we were able to establish that the accident occurred due to the level of intoxication/impairment of the driver. It was also determined that the driver had been served alcohol at a local tavern while was visibly intoxicated, which is a violation of the Pennsylvania Liquor Code for which the tavern was responsible.
